THERE’S a lot to know about property titles, and it’s not always what you would expect.

“If you’re buying a property, you’ll get a title search and a Form 1 cooling-off notice, which provides loads of details,” Mildwaters Byrth Lawyers & Conveyancers lawyer and principal Joel Byrth said.
“But don’t be fooled — just because you have the title information doesn’t mean everything is as it seems. Believe it or not, the boundaries on your title might not match the physical boundaries of the property.
“Sometimes buildings don’t even sit squarely on the land they’re supposed to.
“Imagine buying a home only to find part of it is built on your neighbour’s or council’s land.
“We had a client who, after settlement, discovered that part of their home was on council land — and the council refused to sell that portion.”
Mr Byrth said the best way to ensure your property’s boundaries and buildings are where they should be is to get a land survey before settlement.
However, land surveys can take some time, so taking out insurance at the time of signing the contract will also ensure costs are covered if the title needs to be rectified.
